Appellant was indicted for murder in the second degree. At arraignment with counsel present appellant pleaded not guilty. The jury returned a verdict finding appellant guilty of manslaughter in the first degree and fixed his punishment at ten years in the penitentiary and he was sentenced in accordance with the verdict of the jury.
