We granted writs in this case to review plaintiff's contention that the trial court and Court of Appeal erred in failing to find that the institution of suit by Servi-Clean, one of the creditors of McCarthy Construction Company, Inc., constituted an assertion of the rights of all of McCarthy's creditors under provisions of the Louisiana Bulk Sales Act, R.S. 9:2961-2968.1
