Appellant, Frederick Hamilton Wishon, hereinafter referred to as defendant, along with Sammy Duane Williams, was jointly charged and tried in the District Court, Oklahoma County, Case No. CRF-74-912, for the offense of First Degree Murder, in violation of 21 O.S.Supp. 1973, § 701.1, ¶ 9.
