Co-defendants Gary Staples and Barry Brann were separately indicated for breaking, entering and larceny in the nighttime (17 M.R.S.A. § 2103) and tried before a jury in the Superior Court of Franklin County on December 16 and 17, 1974. At the start of the trial and without objection from counsel, the Court consolidated the cases of the two defendants for trial.
