Mr. JUSTICE DEMPSEY delivered the opinion of the court:

The defendant, Hubert Gregory, and his accomplice, Leroy Dixon, were indicted for the armed robbery of Ben Polisky and for the armed robbery and murder of his nephew, William Polisky. The cases against the two defendants were severed. Gregory waived a jury trial, was found guilty of the three crimes and was sentenced to concurrent terms of 5 to 15 years for the armed robberies...
