JOSLIN, Justice.

The defendant Denis Carpentier's application for post-conviction relief from sentences imposed in the Superior Court on three indictments, each charging uttering and publishing, was denied and he appeals. In our judgment the teachings of Santobello v. New York, 404 U.S. 257, 92 S.Ct. 495, 30 L.Ed.2d 427 (1971), were misapplied by the trial justice and the relief sought should have been granted...
