On March 17, 1975, the grand jury of Shelby County, Alabama, returned the following indictment against appellant:

"The Grand Jury of said County charge that before the finding of this Indictment Undary Hamilton whose true name is to the Grand Jury unknown, otherwise than as stated, did on to wit: May 23, 1974 unlawfully sell, furnish or give away Lysengic Acid Amide, a narcotic drug, contrary to and in violation of the provision of act No....
