Defendant Mervin Payne was indicted, tried and convicted for the murder of his wife, Betty Ruth Payne, in violation of La.R.S. 14:30. After selection of the jury at his trial, held in January 1970, defendant was permitted to withdraw a not guilty plea and enter a plea of not guilty and not guilty by reason of insanity. During the course of the trial defense counsel reserved four bills of exception. On appeal, however, these bills were not perfected...
