Defendant is a licensed lender under article 9 of the Banking Law. On June 12, 1972 plaintiffs procured a loan from defendant which was payable in monthly installments over a three-year period. Essentially, plaintiffs made timely payments, but this action was commenced on December 17, 1974 before the loan was fully repaid.
