The defendant was indicted for murder in the first degree of one Kevin P. Shea and assault and battery by means of a dangerous weapon on one Mark Chinetti. He was convicted by a jury of murder in the second degree and assault and battery by means of a dangerous weapon, and was sentenced to life imprisonment on the murder indictment and to two and one-half to three years on the assault and battery indictment, the term of years to be served concurrently...
