After a court trial the appellant Stevenson was found guilty of burglary in the first degree and was sentenced under the "minors' statute" to an indeterminate term of one to ten years.

The following month it was brought to the trial court's attention that Stevenson possibly had been previously convicted of a felony and thus was not eligible for sentencing under that statute. An evidentiary hearing was had. The trial court found that Stevenson...
