DAY, Justice.

We granted certiorari in this case to review the decision of the court of appeals in Taylor v. Public Employees' Retirement Association of Colorado, Colo.App., 529 P.2d 1356 (1974), reversing an order of the trial court which granted a judgment in favor of petitioner, Dorothy Taylor, and denied a motion for summary judgment sought by respondent, Public Employees' Retirement Association (PERA). We reverse.
