On January 11, 1974, defendant-appellant Joe Lee Winston was charged by information with the crime of theft as defined in IC 1971, 35-17-5-3, Ind. Ann. Stat. § 10-3030 (Burns Supp. 1974), which provides, in pertinent part, as follows:
