Defendant-appellant (Griffith) brings this appeal from his conviction of the offense of Assault and Battery with Intent to Gratify Sexual Desires.

Griffith was arrested and charged by affidavit on August 28, 1972. On August 30, 1972, Griffith was arraigned, entered a plea of not guilty, and the trial date was set for December 4, 1972.
