On May 23, 1974, defendant entered a plea of guilty to first degree assault upon a police officer, § 18-3-202(1) (e), C.R.S. 1973 (1971 Perm.Supp., C.R.S.1963, 40-3-202(1) (e)), and was sentenced to serve a term of not less than 20 nor more than 30 years in the state penitentiary. First degree assault is a class 3 felony and is punishable by imprisonment for not less than five nor more than 40 years...
