ARCHIBALD, Justice.

This case is before us on report pursuant to Rule 72(b), M.R.C.P.

Union Mutual Life Insurance Company (Union Mutual) sought a decision from the Board of Elevator Rules and Regulations1 (the Board) that its home office building is an "industrial plant" and, therefore, not required to have its elevators serviced by a licensed elevator mechanic as is mandated by 26 M.R.S.A. § 439.2
