The defendant, William Geer, is appealing from a conviction for rape.

The defendant and the prosecuting witness had been acquainted for a number of years. Shortly after midnight on November 3, 1973, Geer gained entry into the victim's home by breaking a window in order to unlatch the door. She confronted him in the entryway to the living room.
