This action was brought by plaintiff, Vito Saputo, against defendants, Jerome Fatla, d/b/a Jerry's Shell Service, and Shell Oil Company (hereinafter Shell), for injuries sustained when plaintiff allegedly fell in the restroom of a gasoline station owned and operated by defendants.
