MEMORANDUM OPINION

NIXON, District Judge.

This diversity action was filed against the City of Bay St. Louis, Mississippi, a municipal corporation, seeking damages for serious and permanent personal injuries sustained by the then sixteen (16) year old plaintiff as a result of his having dived off a pier or wharf alleged to have been owned and maintained by the defendant for public recreational purposes.
