CLINTON, Justice.

Defendant was charged with the unlawful possession of a controlled substance with intent to deliver. He waived a trial by jury and pursuant to stipulation of the parties was tried by the court on the record of the evidence received during a pretrial suppression hearing and a report of the chemical analysis of the seized substance.
