On April 17, 1974, the defendant was convicted by a jury of the included offense of assault with intent to rob while being armed, MCLA 750.89; MSA 28.284. He was subsequently sentenced to a term of 10 to 20 years in prison with all accumulated benefits. Defendant now appeals his conviction as of right.
