Appellant, Larry Ray Atwood, hereinafter referred to as defendant, was charged in the District Court, Cleveland County, Case No. CRF-72-213, for the offense of Unlawful Delivery of Controlled Drug, in violation of 63 O.S. 1971, § 2-401, ¶ B 2, and pursuant thereto was sentenced to a term of two (2) years' imprisonment and a fine of One ($1.00) Dollar and court costs.
