The defendant was charged with the crimes of attempted burglary in the third degree and criminal mischief in the third degree. At the trial it was proved that the defendant had been pounding at a jewelry store window with a brick when he was caught by the police. The glass in the window was shattered but not displaced. It cost over $250 to repair the window.
