Trustees for the Lester and Gertrude Roth Foundation (respondents) filed suit against appellant City of Los Angeles for the recovery of an assessment paid under protest. The trial court found in favor of respondents, holding the statutory scheme of Government Code sections 39560-39588 violative of due process and, in addition, finding certain overcharges in the assessment.
