Noah Gene McCollister sued for his personal injuries and property damages when his motorcycle was in collision with a car owned by Ronald Cunningham, driven by Edith P. Cunningham, and insured by Government Employees Insurance Company. The trial court found that the defendant driver was negligent, but rejected the plaintiff's demands on the basis of a finding that his contributory negligence was a cause of the accident.
