Defendant appeals from a judgment of conviction entered by the Circuit Court of the City of St. Louis, Missouri, upon a jury verdict, finding him guilty of possession of a Schedule I Controlled Substance (heroin), §§ 195.020 and 195.200, RSMo 1969, V.A.M.S. Pursuant to the Second Offender Act, § 556.280(1), RSMo, V.A. M.S., the court sentenced defendant to serve five (5) years in the custody of the Department of Corrections.
