Defendant Willie Wynn was originally charged with assault with intent to commit murder, MCLA 750.83; MSA 28.278, and was convicted by a jury on January 30, 1974, of assault with intent to do great bodily harm less than murder. MCLA 750.84; MSA 28.279. He was sentenced on February 27, 1974, to a term of from 4-1/2 to 10 years in prison and now appeals.
