Under Indictment No. 71-112, returned by the Tompkins County Grand Jury in October, 1971, defendant, Eugene Duncan, was accused of the crime of murder of one Gerald Williams, in violation of section 125.25 of the Penal Law, effective September 1, 1967, and in effect on November 11, 1971, and which did not provide for degrees of the crime of murder.
