Fincher was indicted and tried for robbery and the jury fixed his punishment at twelve years in the penitentiary. He was adjudged guilty and sentenced in accordance with the verdict of the jury. He was represented at arraignment and trial by a court-appointed lawyer. He pleaded not guilty. At the time he was sentenced he gave notice of appeal, and he asked that his sentence be suspended. He was furnished a free transcript and trial counsel was appointed...
