This case has an unusual history. On December 17, 1971, defendant was convicted by a jury of armed robbery, MCLA 750.529; MSA 28.797, and subsequently was sentenced to 8 to 40 years in prison. He filed an appeal with this Court on January 17, 1972, and appellate counsel was appointed.
