This case is before us on an appeal by a legatee of a will assigning as error the construction placed on a certain provision of such will in an order of the Probate Division of the Superior Court. The matter came before the court below1 in a petition for instructions filed by the executrix to settle an issue between appellant and the residuary legatees.
