Defendant John K. Whiteside was found guilty by a jury on June 24, 1975, of three counts of willfully attempting to defeat a federal tax, 26 U.S.C. § 7201.1 His motions for judgment of acquittal,2 pursuant to Rule 29(c), F.R.Cr.P., or, alternatively, a new trial,3 pursuant to Rule 33, F.R.Cr.P., are now before the Court.
