On or about August 30, 1970,1 Gene Blair Pendleton was the owner and operator of the Neighborhood Inn, located in Detroit, Michigan. During that evening, plaintiff Odell Kermans was a patron in the inn. At approximately 2 a.m., defendant Pendleton shot and wounded the plaintiff.
