On July 10, 1973, an indictment (No. 3605/73) was filed against defendant charging him with the class A misdemeanor of conspiracy in the third degree, and with the class D felony of possession of a weapon as a felony (6 counts). The latter six counts are of felony grade — rather than a class A misdemeanor — solely because of defendant's 1965 conviction in United States District Court (SDNY).
