INGRAM, Justice.

This is an appeal from an order of the Murray County Superior Court dismissing the affidavit of illegality of the defendant in fi. fa., Richard Brumby, to a tax levy of the state after a jury trial which resulted in a verdict sustaining the levy. We order a new trial for the reasons given in Division III of this opinion, but otherwise affirm the rulings of the trial court.
