QUIRICO, J.

After a single trial in which the defendant was found guilty by a jury of the crimes of assault and battery and assault with intent to rape, a judge of the Superior Court imposed on the defendant a fine of $10 for the lesser crime and a sentence of six to fifteen years to the Massachusetts Correctional Institution at Walpole for the greater crime. The judge then stayed the execution of the sentences and with the consent of the defendant reported both cases...
