ROBERTS, Justice.

Appellant Harry Twiggs was arrested on January 5, 1972, for the murder of Thomas Cirwithian. Thrice a jury was empanelled to try Twiggs. The first jury could not reach a verdict, and the court declared a mistrial. Appellant's second trial also ended in a mistrial when appellant was wounded by a sheriff as he tried to escape from the courtroom.
