The appellant, Lee Harmon, was indicted for the illegal sale of ethchlorvynol, a controlled substance under the Georgia Controlled Substances Act. Appellant filed a demurrer on the grounds that the indictment charged him with a nonexistent offense, that it charged him with two separate offenses in one count and that it was too vague and indefinite; and on the ground that the Georgia Controlled Substances Act was unconstitutional.
