Defendant appeals as of right from his plea-based conviction of the offense of attempted rape. MCLA 750.92, 750.520; MSA 28.287, 28.788. He was sentenced to a term of 40 months to 5 years in prison, to be served concurrently with a sentence in another, unrelated conviction.
