On September 1, 1973, Odell Middlebrooks was arrested and charged with the offense of aggravated assault with intent to rape. He was held in the City of Atlanta jail without benefit of counsel until he was indicted on September 28, 1973. During this period of incarceration, preliminary hearings were scheduled for September 18, 20, and 21, 1973, but were continued each time because of the absence of the prosecutrix.
