Appellant Raymond Miller was indicted for first degree murder by the Marion County Grand Jury on March 7, 1974. He was charged with striking Arie Stanley Byrd with a hatchet on October 2, 1973, inflicting wounds which caused Byrd's death on December 23, 1973.
