OPINION

HOWARD, Chief Judge.

Appellant was charged with and convicted by a jury of one count of rape and two counts of lewd and lascivious acts with a prior conviction of rape and lewd and lascivious acts. He was sentenced to a term of not less than 20 nor more than 25 years in the Arizona State Prison on the rape conviction and to a term of not less than one nor more than five years on each count of lewd and lascivious acts to run concurrently with each other...
