This malpractice suit was previously before this court on an appeal from a prescription-based summary judgment which was reversed. (239 So.2d 180). On remand, defendants filed (subsequent to answer) exceptions of prescription. The case was set for trial before a jury, but over plaintiff's objections, the lower court held an in limine hearing and sustained the exception.
