The defendant was convicted of aggravated assault. The evidence showed without dispute that in the course of an altercation in their bedroom he shot and wounded his wife with a pistol at least twice. Held:

1. The defendant was indicted at the March, 1974, term of the Superior Court of DeKalb County. The case on its first hearing ended in a mistrial, and this trial took place on September 19. Whether or not an earlier list of witnesses...
