This matter is before the court on defendants' motion for partial summary judgment under Pa. R.C.P. 1035(c).

On November 19, 1970, plaintiff, Harry Larks, suffered an eye injury in an industrial accident. He was taken to defendant, Easton Hospital, and after an examination revealed the presence of a sliver of metal, his eye was bandaged and he was referred to defendant, Henry F. Jacobius.
