Michael Lewis was charged on February 16, 1973, with violation of the 1935 Narcotics Act, IC 1971, 35-24-1-2, Ind. Ann. Stat. § 10-3520 (Burns 1956), as amended by Acts 1961, ch. 90, § 2, pp. 172-173.1 Lewis was tried without jury on May 18, 1973, and found not guilty as to Count I, which alleged possession of narcotics paraphernalia, but guilty as to Count II, which alleged possession of heroin.
