PETERSON, Justice.

Plaintiffs appeal from summary judgment granted defendants and from an order denying their own motions for summary judgment1 in this action to recover damages arising out of the alleged unauthorized practice of law by defendant bank with respect to the drafting of certain trust instruments. The evidence upon which the cross-motions for summary judgment were submitted is essentially undisputed.
