For purposes of the Court's dismissal of this action, the relevant facts as hereinbelow stated are not in dispute.

The plaintiff Leslie D. Igleheart, Jr., was a beneficiary of two trusts established under the Last Will and Testament of John Giltner Igleheart, plaintiff's deceased grandfather. One of such trusts was created under Item 19 of said Will and named defendant Merchants National Bank and Trust Company...
