This is a direct appeal in a criminal action in which the defendant-appellant, Cashley Eugene Woods, was convicted of forgery as defined by K.S.A. 21-3710. The defendant was not charged with the making of the forged check but with delivery of the check knowing it to be a forged instrument. Most of the facts in the case were not disputed and were essentially as follows: In December 1973 there was a burglary...
