The defendant, who is a prisoner at Massachusetts Correctional Institution, Norfolk, having been convicted by a jury of rape, assault with a dangerous weapon, and assault and battery, appeals from the denial of his petition for a writ of habeas corpus, which was treated by the Superior Court judge (motion judge) as a motion for a new trial pursuant to the provisions of G.L.c. 278, § 29.
